Standard Terms and Condition of Sale


Customer Agrees

By applying OBMETRA, You accept the obligations and conditions of this Agreement. If You do so on behalf of a legal entity, You represent & warrant that You have the authority to execute this Agreement on behalf of that legal entity. Suppose You do not accept the terms of this conditions or do not have the authority to agree to the terms of this Agreement.

In that case, You shall not apply to set up an OBMETRA account and must cease any further attempt to purchase products using an OBMETRA account or discount. You should carefully review these terms as they contain important information concerning Your legal rights, warranties, obligations, and available dispute resolution remedies.

You shall not violate any United States Federal or state laws, international laws, rules, or regulations in purchasing, selling, or reselling any of the Supplier's products.

OBMETRA reserves the right at any time to modify the terms of this Agreement in its sole discretion, without liability to You or End-Users. We reserve the right to accept or reject any order. You agree to be bound by any changes to this Agreement as modified.

The following sales conditions apply to offers and agreements between OBMETRA (VENDOR) and the Customer (BUYER). Any purchase from VENDOR by BUYER implies the BUYER's express acceptance of these conditions.

Payment

Safe, Seamless, Transactions Ensuring secure and seamless transactions guides the development of the International most secure payments and financial services infrastructure. All mentioned prices include 5% V.A.T. as per U.A.E. tax law.

Delivery Date

The delivery dates are always intended as & quote; indicative & quote; while confirming the order, and the Agreement shall remain fully and unconditionally effective, whatever the delivery date.

Delivery & Return

OBMETRA shall proceed with transport on behalf of and at the BUYER's expense via the method selected at checkout. All transportation, including carriage-paid delivery, is at the BUYER's risk. The VENDOR will only insure the goods for shipment at the BUYER's expense at the BUYER's specific request. The BUYER is responsible for checking the condition and nature of the goods on arrival. 

Any loss or breakage must be notified to the carrier within three days via registered letter with advice of delivery. Any materials not collected within 30 days after notification to BUYER that the order is ready to be shipped/ collected shall be returned to stock and are subject to 10% re-stocking charges. The BUYER is responsible for paying the shipping cost for any materials not contained after the dispatch confirmation. Any complaints relating to deliveries not corresponding to the order must be made immediately to Marine Planet G.T. and confirmed in writing within eight days of delivery
receipt.

In the absence of such a complaint, Ocean Blue Marine Drive Trading shall be exonerated from liability to the BUYER. For the Special Items, the order confirmation will be adequate only after the 100% payment. Shipping is free within Dubai and charges 30 AED within the Emirates of U.A.E. and 100 AED for G.C.C. countries for regular package size as indicated during the order confirmation.

Goods that must return will only be accepted subject to a prior written Agreement from Marine Planet. The maximum period for the return of any goods is 30 days from the date of purchase.

Privacy Policy

Your trust is salient to us. We are well aware of the essence of personal information about you. We will take adequate measures to protect the safety and controllability of your data under laws and regulations.

Significantly, the Policy does not apply to the services provided by any other third party. That shall be subject to the privacy policy separately explained to you.

Information we collect

OBMETRA may collect various information from the Site Visitors. Our Web server also collects general data about every Site Visitor, including the I.P. address, the domain name, the length of time spent on the Site, and the pages accessed while visiting the Site. 

This information is collected to, among other things, aggregate statistical information, facilitate system administration, and improve the content of the Site. Information you provide is not sold, shared, rented, or communicated to any third party. 

Security

OBMETRA places the utmost importance on protecting information transmitted via the Site and will take security precautions to protect all such information. However, it cannot guarantee that any electronic commerce is secure. We will take measures to secure and protect all customer-specific information from loss, misuse, and alteration. 

Use of the information collected

OBMETRA may also use the information collected to notify Site Visitors of changes to the Site, to notify Site visitors of new products made available via the Site, and for any other legitimate and lawful business purpose.

Payment

We are offering both cash on delivery and online payments. Goods will be handed over to the customers after receiving the payment from our carrier. Warranty The VENDOR warrants that its products are free from manufacturing defects and flaws in the materials for one year from delivery, except for some unique items. 

Defective parts will be repaired free of charge or replaced at the VENDOR's discretion. Governing Law and Place of Jurisdiction We reserve the right, at our sole discretion, to modify or replace these Terms and Conditions by posting the updated terms on the Site. Your continued use of the Site after such changes constitutes your acceptance of the new Terms and Conditions.

Username and Password 

When Registering for an OBMETRA Account, you will be asked to select a username and password. You understand and agree that you are solely responsible for protecting the security and confidentiality of your username and password and for all activities (including purchases) that occur via your Account. 

You agree not to allow unauthorized persons to use or access your Account. If you know or suspect that Your Account has been compromised, promptly change your password and immediately notify us. You agree to pay all charges incurred by you or any users of your Account for purchases made on our website.

The customer also agrees to indemnify (including attorney fees) and hold harmless OBMETRA, including its directors, officers, associates, attorneys, subsidiaries, affiliates, parents, etc. For any Claim, litigation, notice, or assertion in any way relating to the use (whether authorized or not) of their OBMETRA account.

The customer must review the product application and all applicable laws, codes, and regulations for each relevant jurisdiction to ensure that the products' construction, installation, and use are compliant.

Product Substitution

Products and/or country of origin may be substituted and may not be identical to descriptions and/or images published in the catalog or on the website.  

 Independent Contractors

Nothing contained in these terms and conditions shall be construed to create a partnership, dealership, reseller, agency, employment, or joint venture relationship. The customer does not have the right to bind or otherwise obligate OBMETRA in any manner, nor may the customer represent that it has the right to do so.

Termination

OBMETRA reserve the right in its sole discretion to remove or delete any or all User Content or other information from Your Account or our website at any time and for any reason. You understand that OBMETRA cannot guarantee that your Account will always be available to You or error-free. OBMETRA may terminate or suspend Your Account for any reason in its sole discretion, with or without notice to you.

Additionally, OBMETRA reserve the right to stop offering any Account feature of our website or any portion thereof, without liability, at any time and for any reason, with or without cause. In the event of any such termination or suspension, information stored in your Account, including User Content and Purchase History, may no longer be available to you. OBMETRA has no obligation to make your User Content or Purchase History available to you, and you should not rely upon your Account as your sole record of this information.

Cancellation

If not prohibited above, all product order cancellations must be approved by OBMETRA and may be denied or subject to restocking fees and other charges.

Complete Agreement

The terms and conditions in (i) OBMETRA forms; (ii) acknowledgments; (iii) quotations; (iv) invoices; (v) websites; (vi) catalogs; and (vii) extension of credit are incorporated herein by reference, and constitute the entire and exclusive agreement between customer and OBMETRA. Except as expressly identified in this agreement, no terms of the customer's, Customer's Purchase Orders, or any other documentation exist. Nor any browse-wrap, shrink-wrap, click-wrap, or other non-negotiated terms and conditions provided by a Customer with an order will constitute a part or amendment of this agreement. 

All other terms and conditions have no force and effect. They are rejected by OBMETRA even if access to or using such Service, documentation, or other Supplier materials requires affirmative acceptance of such terms and conditions.
